What Is Actually in Force

A controlled-status account of the Section 338 duties, exclusions, and implementation sources.

UPDATED AUGUST 23, 2026 · FAST-MOVING MATTER

Three presidential proclamations impose an additional 50 percent ad valorem duty on listed Canadian products through HTSUS headings 9903.03.12, 9903.03.13, and 9903.03.14. Proclamation 11056 moved the effective date from August 19 to August 22, 2026.

IN FORCE
U.S. Section 338 duties. Listed goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. Eastern on August 22.
VERIFY CURRENT
HTSUS coverage. Classification, exclusions, and technical corrections must be checked against the current Harmonized Tariff Schedule and customs guidance.
IN FORCE
Existing Canadian counter-tariffs. Canada’s steel, aluminum, and automobile measures remain subject to their governing orders and remission programs.
ANNOUNCED
Additional Canadian response. Do not describe the proposed September 8 response as operative until Canada publishes the final legal instrument and tariff schedule.

Coverage limits

  • Articles already subject to specified Section 232 duties are excluded under the proclamations.
  • Most civil-aircraft agreement articles are excluded, subject to the proclamation language.
  • Foreign-trade-zone merchandise may require privileged foreign status under 19 C.F.R. part 146, subpart D.
  • The duties generally stack with other applicable duties, taxes, fees, exactions, and charges unless an exception applies.
Publication control. Proclamation 11056 must be linked wherever the original August 19 effective date appears. Preserve the original proclamations; add the amendment as a related record rather than overwriting their history.

Scale of the package

The Federal Reserve Bank of Chicago counted 569 eight-digit tariff categories and estimated approximately $24 billion in annual affected trade using May 2026 data—about 5.5 percent of imports from Canada. USTR described nearly $20 billion in covered value. Present the result as a range and identify the source and method.
